General Terms and Conditions (GTC)

1 Scope of Application(1) These General Terms and Conditions apply to all contracts, services, classes, workshops, personal training sessions, duo training sessions, and other offers provided by The Pilates Place Berlin (hereinafter referred to as the “Studio”).(2) These GTC apply to consumers and businesses unless otherwise expressly agreed.(3) Deviating terms and conditions of customers or contractual partners shall not apply unless expressly accepted by the Studio in writing.
§ 2 Services Offered(1) The Studio offers in particular:- Pilates group classes
- Personal training sessions
- Duo training sessions
- Workshops
- Special events
- Other health and movement-related services(2) The type, scope, duration, and location of the services result from the respective booking, service description, or individual agreement.(3) The Studio is entitled to provide services through employed staff members or independent trainers/freelancers.
§ 3 Conclusion of Contract(1) Services may be booked in writing, electronically, by telephone, through booking systems, or on-site.(2) The contract shall be concluded upon booking confirmation or actual participation in the respective service.(3) The Studio is entitled to reject booking requests without stating reasons.
§ 4 Prices and Payment Terms(1) The prices valid at the time of booking shall apply.(2) All prices include statutory VAT where applicable.(3) Payments are due immediately upon invoicing or according to the agreed payment terms.(4) In the event of default in payment, the Studio is entitled to charge statutory default interest.(5) If a customer is in default of payment, the Studio may suspend further services until all outstanding amounts have been settled.
§ 5 Appointments and Cancellations(1) Agreed appointments are binding.(2) Personal training sessions, duo training sessions, or individual appointments may be cancelled free of charge up to 24 hours before the scheduled appointment.(3) In the event of later cancellation or non-attendance, the agreed fee may be charged in full.(4) The Studio reserves the right to cancel or reschedule classes or appointments for organizational reasons, illness, insufficient participant numbers, or force majeure.(5) Payments already made for cancelled services shall either be credited or refunded at the Studio’s discretion.
§ 6 Participation Requirements and Health(1) Participation in all services is at the participant’s own responsibility.(2) Each participant is obliged to inform the Studio before participation about existing health restrictions, injuries, pregnancies, or relevant illnesses.(3) The Studio does not replace medical advice or treatment.(4) In cases of doubt, participants should seek medical advice before participation.(5) The Studio may exclude participants from participation if health risks exist.
§ 7 Liability(1) The liability of the Studio and its legal representatives, employees, and agents shall be governed by statutory provisions.(2) The Studio shall have unlimited liability in cases of intent, gross negligence, and injury to life, body, or health.(3) In cases of ordinary negligence, the Studio shall only be liable for breaches of essential contractual obligations. In such cases, liability shall be limited to foreseeable and typical damages.(4) The Studio accepts no liability for items brought onto the premises, in particular valuables, clothing, or personal belongings.(5) Use of the premises and equipment is at the participant’s own risk.
§ 8 Conduct Within the Studio(1) Participants must follow the instructions of Studio staff and trainers insofar as these serve safety, organization, and the proper execution of services.(2) The Studio may exclude participants from services in the event of inappropriate conduct, disruption of operations, harassment of other participants, or violations of these GTC.(3) In such cases, no refund claim shall arise.
§ 9 Vouchers(1) Vouchers are transferable unless otherwise agreed.(2) Vouchers are valid for three years from the date of issue, to the extent permitted by law.(3) Cash payment of vouchers is excluded.
§ 10 Data Protection(1) The Studio processes personal data exclusively in accordance with applicable data protection laws, in particular the GDPR.(2) Further information can be found in the separate privacy policy of the Studio.
§ 11 Photo and Video RecordingsPhoto and video recordings within the Studio are only permitted with prior consent of the Studio.
§ 12 Force MajeureThe Studio shall not be liable for impossibility or delays in performance caused by force majeure or other unforeseeable events beyond the Studio’s control.
§ 13 Final Provisions(1) German law shall apply.(2) Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected.(3) To the extent legally permissible, the place of jurisdiction shall be Berlin.(4) Amendments or additions must be made in writing.
